Consumer Health Data Privacy Notice

Pursuant to the Washington My Health My Data Act (the “Health Privacy Law”), Choice Hotels International, Inc. (“Choice”, “we” or “us”) is providing the following details regarding the categories of personal data defined as “Consumer Health Data” that we collect, use, and share. This Washington Consumer Health Data Privacy Notice (the “Health Privacy Notice”) supplements the Choice Hotels International Global Privacy Notice (“Global Privacy Notice”). Choice owns and operates the following properties in Washington state:

  • County Inn Seattle-Bothell
  • Radisson Hotel Seattle-Tacoma

 

As described in our Global Privacy Notice, the categories of Personal Information we collect depends on the context of your interactions with us, the choices you make, the tools or features you use, your location and applicable law. In the event of a conflict between any other policy, statement, or notice and this Health Privacy Notice, this Health Privacy Notice will prevail as to Consumer Health Data collected in the state of Washington. Capitalized terms not defined in this Health Privacy Notice have the meanings set forth in the Global Privacy Notice.

“Last Updated” refers to when this Health Privacy Notice was last revised. Changes become effective when we post the revised Health Privacy Notice on our platforms.

Consumer Health Data

For purposes of this Health Privacy Notice, “Consumer Health Data” means Personal Information that is linked or reasonably linkable to a consumer and that identifies the consumer's past, present, or future physical or mental health status including without limitation individual health conditions, treatment, diseases or diagnosis, biometric data, precise location information, diagnostic testing, treatment or medication.

Consumer Health Data We Collect, Use, And Share

We may collect the following categories of Consumer Health Data when you interact with us online, in person, or over the internet either directly from you, or in some cases through technologies such as chat features or interactive voice response (“IVR”). If you are staying at a property at one of our Franchised Hotels, the Consumer Health Data they collect is not covered by this Health Privacy Notice and is not retained or processed by Choice.  Consult the Franchise Hotel for relevant details relating to that collection and processing.

  • Information you share about health-related conditions such as food allergies or requests for accommodation during your stay based on conditions such as visual or hearing impairment;
  • Information that may include injury or illness symptoms, required treatment, use of or need for medications, diagnosis, or other interventions such as in the instance of an illness or injury on-site;
  • Bodily functions, vital signs, symptoms or measurements of similar information;
  • Precise location information associated with your request for, or receipt of, health services or supplies during a stay;
  • Other information that may be used to infer or derive data related to the above or other health information;
  • Information that we, or our processor, may use or process to associate or identify a consumer with any of the information listed above that is derived from non-health information;
  • Other Consumer Health Data with your consent.

 

Sources of Consumer Health Data

Choice does not collect your Consumer Health Data unless you voluntarily provide it to us or consent to it being provided.  Consumer Health Data may be collected:

  • Directly from you if you provide it when you make a reservation or a request from our staff, provide it by way of a comment box, open text field or customer support exchange, including by way of a Chat Feature or phone message;
  • Indirectly from you such as using technology devices like thermometers, O2 readers or blood pressure cuffs;
  • Authorized representatives acting on your behalf, for example a family member if you are injured or too ill to provide it directly or from a medical provider pursuant to your approval;
  • Automatically as you navigate through our website (IP address, device identifiers, information collected through cookies and other Tags);
  • Third party sources such as government entities, our Service Providers, public sources or legal advisors;
  • Other sources with your consent.

 

Use of Consumer Health Data

We collect, use, and share the Consumer Health Data listed above with your consent, as reasonably necessary to provide you with services you have requested or authorized and for the purposes below.  Where required by applicable law, we will obtain your consent to share your Consumer Health Data. We do not “sell” Consumer Health Data, as defined in the Health Privacy Law.  We use your Consumer Health Data to:

  • Fulfill requests for accommodation;
  • Fulfill requests during your stay such as providing special equipment, assistance or dietary needs and preferences and other customer support;
  • Assist in the event of an emergency;
  • Respond to and investigate an incident or event such as one that requires medical assistance or care, including reporting, remediation or other ancillary activities in the wake of an incident;
  • Comply with applicable laws such as OSHA;
  • Document, process, manage and resolve claims and enforce our legal rights;
  • Perform auditing, testing, research, analytics and product or service improvement such as investigating unusual incidents, modifying facilities, revising signage, improving safety operating procedures, developing customized features or programs including those relating to health and wellness;
  • Take steps to protect you, your property or third parties from injury or harm;
  • Evaluate or conduct commercial transactions such as mergers, divestitures, restructuring, reorganization, dissolution or other sale or transfer of some or all of our assets whether as an ongoing concern or as part of bankruptcy, liquidation, or similar proceeding, in which information held by us is among the assets transferred; and
  • Other uses with your consent.

 

Sharing Consumer Health Data

Choice will transfer, disclose, distribute or share your Consumer Health Data with select trusted parties to provide you with the products and services you requested from us, for any purpose for which you provided consent, or to comply with the law. Subject to your rights under applicable laws, we may share your Consumer Health Data with:

  • Properties where you have a relationship such as a booking or reservation or where an incident has occurred, and with Choice Hotels International, Inc.;
  • Healthcare providers or emergency responders;
  • Other individuals such as family members or representatives as directed by you and your interactions with us;
  • Third party service providers (“Service Providers”) with whom we have contractual relationships including travel insurance companies, IT providers, law firms, and consultants;
  • Government agencies, law enforcement, regulators and courts where we are required to comply with applicable laws, regulations, official requests or legally binding processes;
  • Professionals such as auditors, consultants, lawyers, and other entities who use the data to provide us with professional services;
  • Parties to litigation;
  • As necessary and appropriate to conduct and protect our operations and which are consistent with our Global Privacy Notice; and
  • Other third parties with your consent.

We may also anonymize, aggregate or otherwise strip any Consumer Health Data we collect of all personally identifying characteristics and may use or share that aggregated, anonymized data with third parties for any purpose we deem appropriate. We maintain and use this information only in a de-identified fashion and will not attempt to re-identify such information, except as permitted by law.

Consumer Health Data Privacy Rights

If you are a Washington resident, you may have the right to submit some or all of the following requests regarding your Consumer Health Data, subject to applicable law and certain exceptions:

  • You have the right to confirm and access whether we are collecting, sharing, or selling your Consumer Health Data, as well as a list of third parties with whom your Consumer Health Data is shared or sold and obtaining a copy.
  • You have the right to request deletion of your Consumer Health Data. If you make a request to delete, we may ask you to confirm your request before we delete your Consumer Health Data.
  • You have the right to withdraw consent from the collection or sharing of your Consumer Health Data.
  • You have the right to appeal our decision if your request was denied, you may appeal our decision within a reasonable period after receiving a denial notice.

 

Exercising Consumer Health Data Privacy Rights

You may submit the above requests, including appealing our denial of a previous request, at no cost and without the need to create an account, by sending us an email at privacyinquiry@choicehotels.com.

To help protect your Consumer Health Data we will request information from you to verify your identity and understand the scope of your request. If we cannot verify the authenticity of the request, we may, but are not obligated to, request additional information to authenticate you.
